When does the seller get paid?

The seller gets paid once all other steps of the closing process have been completed and approved by an attorney. This includes the signing and notarization of all closing documents related to the transaction. Once the Buyer’s funds have been cleared, the money will be disbursed to the Seller.

Where is the buyer’s money held before it is disbursed to the seller’s account?

The Buyer provides the balance of the purchase price to be held in a separate escrow account pending the closing of the transaction. The funds will not be disbursed to the Seller until they have been cleared by the bank providing the escrow account.

What is a deed?

A deed is a legal document which is used to transfer from a person or entity certain rights in a parcel of real estate to another. It is used in all purchases sales gifts or other transfers of real estate.

Are there different kinds of deeds?

The two most common types of deeds are the Warranty Deeds and Quitclaim Deeds.

A Warranty Deed (“General Warranty Deed”) is the type of deed most commonly used in timeshare title transfers. A warranty deed transfers all rights to a property from a Grantor (Seller) to a Grantee (Buyer.) However, a warranty deed also contains certain promises or guarantees about the property made by the Seller to the Buyer. Warranty Deeds are used to ensure that the Buyer is getting exactly what the Seller claims—nothing more or less. If any of the warranties are later found to be false, the transaction may be legally challenged.

A Quitclaim Deed, on the other hand, simply transfers all rights to the Buyer without any guarantees about it being claimed. All representations about it are made either verbally or through other documents. However, the transaction may not be as easily challenged should the new Owner later discover discrepancies about the property and the manner in which it was represented. These are usually used in transactions such as gifts, where no money is exchanged.

Is joint ownership possible with timeshare properties?

Yes, two or more individuals may obtain ownership of a timeshare property. However, the exact nature of the joint ownership should be considered. A “tenants in common” relationship implies that all owners share equal proportions of the property, which may consequently be passed on to heirs as outlined by a will. The owners may also claim “joint ownership with right of survivorship.” In the case of one owner’s death, this arrangement would mean that all rights are passed on to the surviving owners—regardless of what may be claimed in the deceased’s will.

How is a deed recorded in a timeshare title transfer?

It generally must be filed in the county in which the title is located, at the Clerk of the Circuit Court. Recording the deed is extremely important in assuring that the transaction appears in the chain of title, should any complications arise further down the road. The recording of the deed with the proper government agency is part of the timeshare title transfer service.

Rescue Your Resort! Sell Do Not Foreclose!!!!

If you own a timeshare and are struggling to keep up with the maintenance fees every year, not to mention the occasional special assessments, you might wonder what would happen if you just stopped paying the maintenance fee and allowed your timeshare to get foreclosed on.

If your timeshare is actually paid for, this may seem like an easy way out. But if you are thinking that the resort's HOA (homeowners association) will just let you slide on the maintenance payments and repossess the timeshare, no harm no foul, that is very far from the truth about what will happen.

There are big consequences to allowing a timeshare foreclosure. So you want to avoid it if at all possible. You don't want to take that kind of hit on your credit report, especially if you are already in financially difficulties. Damage to your credit usually only makes things worse.

If you decide to simply stop paying your maintenance fees (or your loan if you still have one), you will end up taking a pretty big hit to your credit rating.

In addition to that though, you may find yourself on the receiving end of aggressive collection agency phone calls and letters and eventually either the HOA or the timeshare developer may decide to both foreclose on your timeshare and seek a judgment against you. So in the long run, you may not even get out of paying what you owe.


Alternatives to Timeshare Foreclosure

This advice here is primarily for owners who have already paid for their timeshare. If you no longer can keep up with your annual maintenance fees or special assessments, your best option is to get rid of the timeshare. This may take some time and may cost you a bit more money in the short term, but once you can transfer the ownership to someone else, you can breathe a sigh of relief.

First things first though, pay what you currently owe. If you are delinquent with your maintenance fees right now, try and get the money together to pay it. You don't want to risk a ding on your credit report for late payments or non-payment.
1. Sell your Timeshare

If you own a desirable resort and your week is highly sought after as well, you shouldn't have any problem selling the timeshare as long as you set a reasonable price. You can check completed auctions on Resorts Rescued to get an idea of what your week is actually worth.


Just keep in mind that the best way to sell your week or points sooner rather than later is to set the right price. This will usually be MUCH lower than what you paid for it -- as much as 35% less, depending on your resort and the brand. So walk into this with your eyes open and set a fair price upfront and you will be out from under your maintenance fees that much more quickly.
Start with an offer that asks the buyer to pay only closing costs. If that doesn't work, then you can offer to pay closing costs, but I would wait on that. If you are current with this year's maintenance fees, you probably have a bit of time to play with. Your goal is to get your timeshare sold before next year's bill comes due.




If you still owe big bucks on your timeshare, you have a lot fewer options. Most of the time, your unit won't be worth what you owe on the loan. In this situation, you may want to approach the developer's association about deeding back your timeshare to them. In most cases, they won't even consider this option, but if the property is still in development and/or the construction phase and they are actively selling it, you might have a little more bargaining room to maneuver.

At any rate, you should at least talk to Resorts Rescued before you make any decisions about defaulting on your loan. Because of the times we are in, many people are experiencing the exact same difficulties you are and so you may find some companies are willing to help you avoiding foreclosure because it saves them money and hassle as well. Timeshare foreclosures are a big hassle for the developers as well.

What is a Timeshare?

A timeshare is a form of vacation property ownership in which the owner has a deeded or right to use agreement with a resort for a designated period of time. Timeshares have become a great alternative to the high cost of owning a vacation home.
What is the difference between fixed, floating and flex weeks?

Fixed Weeks will usually be identified by a number. For example, the first week of January is Week 1, and the last week of December is Week 52. Most fixed weeks begin on Friday, Saturday or Sunday. When you have a fixed week you can only stay at the resort during your assigned week.

Floating Weeks require you to contact the resort to designate your desired week. You can make a reservation for any time during the calendar year based on a resort's availability (some weeks are always excluded for upper level memberships).

Points are units of measurement used to establish the value of seasons, sizes of suites, and resort locations. Primarily multi-destination resorts such as Wyndham, Bluegreen and Monarch use points. Multi-destination point programs offer the owner a variety of resorts to choose from as well as flexible use options.
What is an Exchange Company?

An exchange company gives you the option to stay somewhere other than your home resort. You can exchange your week for one at a comparable resort. There are several timeshare exchange companies.


When dealing with an exchange company, the owner has the option to reserve or deposit unused weeks to be used at a later time. The owner typically has 2 years to use the week in the exchange company's network of resorts. However, for a fee the banked time can be extended up to one year.
What is the difference between a Five-Star resort and a Gold Crown resort?

A Five-Star resort is the most desirable rating for a resort in the Interval International system. A Gold Crown resort is the most desirable rating for a resort in the RCI system.
What is the difference between Red, White and Blue Seasons?

Each resort will have different seasons, and this has a significant impact on the demand of any timeshare property. Most resorts use 3 principal colors to determine the demand of the season. Red is peak or high season, white is mid season and Blue is off peak or low season. Since demand affects price and trading power, seasonal fluctuation of demand is an important factor to consider.
What is a Maintenance fee?

A maintenance fee is a mandatory fee that the resort charges for the upkeep of the property. In most cases this fee also covers taxes, utilities, insurance, and any other maintenance expenses. These fees are generally levied on a monthly, annually or biennially basis.
What does RTU mean?

RTU stands for Right to Use. In locations where deeded ownership of vacation properties is not permitted by law (primarily outside the United States) the owner will be given a contract very similar to a lease to define a claim to the property. RTU contracts usually range from 20 to 99 years.
How is pricing determined for timeshare resort properties and timeshare resales?

Pricing of timeshare resort and timeshare resale resort weeks varies depending on many factors including: time of year, location, resort amenities, size of the unit, and of course, market demand.
The resort charges a lot more than the resale market. Why is that?

Much of resort developers costs are sales and marketing related. When you purchase directly from the resort, unfortunately you are paying to absorb all of the administrative and marketing costs associated with the sale of the property. When buying on the resale market, you only pay for the market value of the property.
What is the difference between Biannual and Biennial?

Biannual allows the owner to receive two weeks per year. Biennial allows the owner to receive one week every two years.

To enjoy the benefits of vacation ownership, or timesharing, consumers make a one-time purchase of a share of furnished resort accommodations, choosing from a wide range of products designed to suit any lifestyle. Vacation owners enjoy spacious accommodations, a variety of on-site amenities and services, and flexibility in their travel options through vacation exchange. By trading some or all of the time they own, consumers can take advantage of different vacation experiences at thousands of resorts around the world. All shared ownership resort interests come in two basic forms: a deeded interest in real estate and a right-to-use, or non-deeded, interest. These two basic forms are called by many names, some required under state law and others adopted for marketing purposes. However, the majority of shared ownership resorts today convey a use right backed by a deeded interest in real property by whatever name it may be called. Deeded real estate interests are usually called "timeshare estates" under state law, and non-deeded interests are "timeshare uses" or "timeshare licenses" officially, but may also be called "memberships." Timeshares Traditional timeshares regardless of whether they are backed by a deed or not, allow buyers to purchase an increment of time, typically one week, in a condominium or apartment type of furnished accommodation. Timeshare owners receive either a fixed week or a floating time reservation arrangement that may vary by unit type and season. More than two-thirds of timeshare interests today are deeded. Fractional/private residence club These owners typically purchase accommodations with related use rights in increments of more than two weeks and sometimes as long as three months (a quarter share). This type of ownership is almost always deeded and is a more affordable alternative to a second home. Owners benefit by avoiding the ongoing maintenance responsibilities of an entire second home, and usually enjoy a high level of service as part of the product. This product segment is considered the luxury tier of shared ownership. Vacation Club This name generally describes a company or related group of resorts that offers consumers vacation accommodations in more than one location. When a consumer purchases an interest in a "vacation club," it is either deeded or non-deeded like any other vacation ownership interest. If the vacation club interest is deeded, the consumer is usually said to own at a "home" resort at which he or she has a priority right of use. Even if the vacation club interest is not deeded, the consumer could still have a home resort or could have a "membership" in the club that entitles him or her to use any of the club's component resorts. Vacation clubs offer highly flexible use of multiple resorts, subject to certain advance reservation priorities and rules. Some well-known timeshare companies market their properties as a vacation club that provides their consumers with both a deeded interest in real property and multi-site flexibility. Exchange An exchange company allows existing timeshare owners to trade their timeshare interests for comparable accommodations and travel-related services. Most resorts are affiliated with an exchange company, and many resort companies also offer an internal exchange mechanism that allows owners to exchange to resorts within their resort group. If an internal resort exchange is mandatory or long-term, it is usually considered to be a vacation club. Fractional and private residence club resorts may offer exchange opportunities for their owners as well. Some exchange companies have a special program for these kinds of resorts. Points Points are another aspect of vacation ownership that allows consumers to use their vacation product in a highly flexible fashion. Points are simply a numeric representation of the relative use management value of the timeshare or fractional interest purchased, which again can be either a deeded or non-deeded interest. There are a few companies that offer "pure points" without the sale of an underlying specific timeshare interest. By purchasing points in any of their formats, the consumer can use their points to reserve different combinations of accommodation sizes, locations and seasons, and may also be able to acquire a variety of travel services depending on the rules of the timeshare company. Think of points like tickets, symbolic of the product or service being used or reserved. Vacation ownership is highly regulated. The various products described above must comply with strict standards set forth in state timeshare laws as well as several federal laws before being offered to consumers. For nearly 40 years, ARDA members have worked with federal and state governments to support consumer protection legislation. As a result, purchasers have a five- to seven-day rescission period in most states that allows them time to cancel a purchase contract for any reason and get their money back. Further, most state timeshare laws require truth in advertising, protect purchasers' timeshares from the developer's debt, and assure that purchasers receive detailed information about the timeshare plan they are buying, including the type of timeshare interest, how to use the product, management and budget information and much more.
